Administration of Eastern Michigan University;
I am writing this today to beg you to do more to protect your employees still being required to work on our campus. Employees of the Physical Plant and Dining are on the front lines of this for the University.
The members of AFSCME 3866 and others have been showing up everyday to care for students and this campus from the first day of the closure. These employees feel you have yet to show up for them. You have yet to give employees personal protective equipment and training for their use or any special training on cleaning procedures. They are working despite the risk of their own safety and safety of their families.
Buildings that have been disinfected are still being made available to the community. These buildings once cleaned should be locked and made unavailable to everyone, with a few exceptions, until a decision is made on how to safely reopen them to insure no re-contamination.
Your employees are punching time clocks in the same space, limiting the number punching time cards in a closed space does not change the risk of spreading COVID-19, if one infected person coughs everyone walking into that area is at risk. Wayne State University confirmed two employees have tested positive for COVID-19. What has to happen for you to protect your employees?
The members of AFSCME 3866 ask for this Administration to protect them. Give them the ability to feel safe and protect their families without fear of losing their jobs or what financial security they have. For employees required to continue working, provide them training, ensure personal safety equipment is available and used, minimize their risk for exposure, and recognize them for their outstanding work and commitment to the students of this institution during this unprecedented time.

Thank you for your note. On behalf of President Smith, Provost Longworth, and the rest of the EMU community, I’d like to thank you and your members for the excellent job they have been doing during these difficult times. We recognize your and your members’ extra efforts – in addition to the efforts of many others all across campus – to ensure EMU is able to continue providing safe, quality educational experiences for our students.
I’d like to address a few of the specific concerns you raise in your email below.
Personal Protection Equipment (PPE) has been provided to Physical Plant staff who are currently working on campus (and to other staff who are similarly situated). If there are individual instances where your members are saying this is not the case, I ask that you reach out to me directly to address each specific issue on a case-by-case basis.
As for safety training and guidance, I understand Dieter Otto has met with all Physical Plant staff who are currently working on campus and reviewed Washtenaw County Health Department COVID-19 related safety guidance on prevention, cleaning and disinfecting with them. This guidance is also available on EMU’s COVID-19 website. Additionally, all custodial staff go through disinfectant training for restroom fixtures when they initially become employed by the EMU custodial department. This is the same disinfection process used for SARS0-CoV-2. In fact, whenever a new line of chemicals is introduced (including disinfectant) each building team that uses them is provided training on the proper use of such chemicals. I also note that additional training was provided on August 14, 2018 and February 28, 2019 for EMU employees on the two teams who are using the washing and fogging disinfecting method using the Kaivac power washer and Clorox 360.
Upon learning of the time clock issue, we immediately initiated a procedure, consistent with Health Department guidelines, where no more than 10 people congregate for clock-in and clock-out purposes. The Physical Plant is currently working on a procedure to temporarily eliminate the use of time clocks altogether. Your members should be in touch with their supervisors on that issue.
EMU is continuing to examine the issue of building accessibility for faculty, staff and students. We understand your concerns in this regard and ask for your continued patience as we create solutions to address issues that arise in this evolving crisis.
President Smith also made an announcement this evening related to additional, temporary COVID-19 related leave. Please have your members review tonight’s message from the President for additional details. Please also encourage your members to review each of the President’s almost daily messages and to check EMU’s COVID-19 website for additional information and updates.

Article V
Section 4. To be eligible for office, a member must be in good standing for one year immediately preceding the election: provided, however, that no retired members shall be a candidate for office.
Section 8. A bargaining council consisting of four (4) representatives from each representation unit shall be elected at the regular December membership meeting prior to the expiration of the existing contract. This council shall assist the contract negotiating committee in preparing a list of demands to be presented to the university.
Section 9. The contract negotiating committee shall consist of the president, vice-president and one elected representative from each representation unit. The three (3) unit representatives shall be elected at the regular December membership meeting prior to the expiration of the existing contract and will remain in that position until the next committee is elected.
Article VII
Section 5. The trustees shall make or cause to be made at least semi-annually an audit of the finances of the local, including the finances concerning any health and welfare, pension, insurance or other benefit programs covering members of such local, and shall report to the membership on the results of such audit.
Section 6. The executive board shall be the governing body of the local union except when meetings of the local union are in session. All matters affecting the policies, aims and means of accomplishing the purposes of the local not specifically provided for in this
constitution or by action of the membership at a regular or special meeting shall be decided by the executive board. The board shall meet at the call of the president or of a majority of the members of the board. A report on all actions taken by the executive board shall be made to the membership at the next following meeting. A majority of the members of the executive board shall be required for a quorum.
Article IX
Section 1. There shall be a chief steward, and enough district stewards to cover the necessary localities in each representative unit, in accordance with the union contract.
Section 2. The chief stewards and alternates shall be elected at the regular December meeting following nominations made at the regular November meeting in even-numbered years, or when 40% of the representation unit members petition for a new election.
Section 3. The chief stewards and alternates shall be elected by the people of their representation unit for a period of two (2) years in accordance with election procedures. Duties of the chief stewards and alternates shall be as stated in the contract. It is the duty of each chief steward to meet with the district stewards on their representative unit, at least once every three (3) months when deemed necessary.
Section 4. District stewards and alternates are elected by the members of each district for a period of two (2) years. When a vacancy occurs or by request of 40% of the district members, an election shall occur in accordance with election procedures. The duties of
the district stewards and their alternates are those stated in the contract.

It is that time of year again to exercise a provision in the Sick Leave Article to receive a 24 hour payout of your sick time if you have not used more than 80 hours in this fiscal year (July 1 -June 30). You must let your supervisor know and it would be best to have it in an email that you are requesting your 24 hour sick leave payout.

The University has proposed a Memorandum of Understanding involving reduction of hours for a majority of the Custodial Group for the summer months. The affected members will be voting to accept or reject the understanding.

Section 23.11 Employees who work a total of sixteen (16) continuous hours, and is scheduled to work the following day, may request to change his/her starting time for the following day for up to a maximum of two (2) hours. The employee must seek and receive prior approval from the Supervisor/Foreman for all such changes. The employee shall receive up to a maximum of two (2) hours paid administrative leave to cover the absence. Any dispute arising out of a denial of a request or the application of this provision shall not be subject to appeal in the grievances procedure.
The underlined portion changed from a member needing to use his or her own vacation/sick time to cover. Please keep the union informed if this is used or a supervisor denies the start time change. We cannot file a grievance but we can call for a special conference if we are continually are being denied or being treated unfairly.

The tentative agreement reached on June 8, 2016 has been ratified by the membership. The effective date of the agreement will be July 1, 2016 as long as the Board of Regents approves the contract. Thank you to everyone that assisted with this contract.

The tentative agreement is attached below. Ratification vote will be held on Monday June 13, 2016 6:30 am until 3:00pm in the union office. One important note not mentioned this morning is that the benefits starting January 1, 2017 will include an eye exam every year and 2 hearing aids every 3 years.

The negotiations team has reached a tentative agreement for a 3 year contract with the University. Tentative Agreement Presentation will occur starting at 7:00am and a second presentation at 8:30am on Friday June 10, 2016 in the Student Center, room 208 (correction). Ratification vote will be held on Monday June 13, 2016 6:30 am until 3:00pm in the union office.

There is AFSCME Council 25 Region 4 steward training scheduled on Saturday, June 11, 2016 in Ann Arbor. Prior registration is required before 5:00PM on Wednesday June 8 if you would like to attend. The local is providing an incentive for any elected position of the local union to attend. This includes district stewards, chief stewards, alternates, eboard members and others. Topics will be setting election for the open Alternate Chief Steward Midnights position, negotiations, arbitration updates and some updates from other College/ University unions around the state.
If you have not yet provided your suggestions and concerns for negotiations we need them submitted no later than Tuesday, April 5 before the Membership Meeting. There has been some confusion as far a vacancy language. I have attached the language with changes from the Tentative Agreement added below. Also here are a few key points.
-When bidding on an open position same class applicants will be awarded the position by seniority (example: FM6 Custodian bidding on FM6 Custodian position)
-If there is no same class applicant then the employer may choose from the 3 most senior qualified out of class bargaining group applicants to fill the position (example: FM6 Custodian bidding on FM12 Groundsperson position)
-The successful bidder has 20 days to transfer back to old position
